To those asking questions from other than Minnesota, I would like to thank you for taking the time to write in your questions; but I am SORRY that I cannot answer them because the laws vary from state to state. If you are looking for my opinion on a situation, please put OPINION at the top of your question and I would be more than happy to answer. If you are looking for the answer to a specific law, you have a few options.
1) Call your State, County or Local Police, and ask them the question.
2) Go on the Internet and lookup your state laws there.
3) Go to the local library and lookup the state laws there.
The first one would be the choice I would give you, but you can decide which one you want to use. Once again thank you for reading through my column and I truly hope that you will find the answer you're looking for.

Question - Is there a maximum length that a trailer hitch can extend pass the bumper of a van, auto or pick-up truck? I was involved in a rear end collision with a van that had an extended trailer hitch that was from 2-3 feet pass the rear bumper.
When I hit the trailer hitch, I slid up on top of it and hit the 2 rear doors of the van with my SUV. The next day I stopped to take some pictures of the van damage and the owner had changed the trailer hitch to a smaller length one.
I realize that I am still responsible for the rear end collision, but I don't think I would have hit the van had it not had such a long extended trailer hitch.

Question - I work at an auto auction, and we use in-transit plates for delivery and pickup of customer’s vehicles. What are the Minnesota laws pertaining to license plate display. I have been told it is illegal to have more then one plate displayed, is this true. I would be interested in knowing what you can and can't do.

Question - I am moving to Minnesota from North Dakota and just put tabs on my vehicles for ND last month. ND will not refund me anything for the months that I will not be living in their state. So my question is what would happen if I drove my vehicle, as a MN resident, with ND plates in MN. The plates are not expired or anything, its just I paid over $150 for tabs that I will not need for 11 months and then to get it all changed to MN will be over $300. Am I able to get my moneys worth with my ND plates? I would swtich over to MN right away if ND would credit me back, but they said they will not.

Question - I was pulled over on November for DWI. It is my first and hopefully only one, however my B.A.C was .20. Long story short, It was pled down to a .10, however I still received the "whiskey plates" My questions are,
1. Is it common to get these plates on a first offense?
2. Will I get a B card when I receive my license again?
3. When my 6 months restrictions are over, can I exchange these plates?

Question - I am dealing with a legal issue involving a scooter. I read the definitions of electric asst. bicycle, it does not qualify as one. Question - It seems so many people these days ignore the lane right of way. The MN driving rules state that a motorist turning left onto a four lane road from a single turn lane must enter the left lane and stay in that lane for 100 feet and signal if they wish to enter the right lane. OK, I am on the opposite side of the intersection turning right. I have the right of way to that lane Right? So many people turning left cut right across into the right lane. If I was hit by them who would be at fault?

Question - I'm submitting this for a friend.
I would like to know the avenue to pursue a complaint for negligent behavior on the part of a trooper. My friend was traveling in a caravan of our friends down the freeway, obeying the speed limit, when he noted a trooper who had already stopped another motorist on the opposite side of the freeway. He continued on his way only to find said trooper flying up behind him at 100+ mph. he promptly pulled over to the side of the road. Several friends in the caravan noted the officer's speed as ridiculously excessive.
When he got to the car, he told my friend that he had been stopped because he had no front plate and his tint was too dark. This begs the question: since when is it appropriate for an officer of the law to endanger the lives of several motorists to chase down a person who's endangering the lives of none? Yes, the parts on my friend's car were illegal. That is not the issue. i could understand him being stopped under normal circumstances. the issue here is that this officer blatantly risked the lives of several of my friends to pull someone over for something as insignificant as TINT! The illegality of it at this point is moot- this officer used excessive means to stop him for something that was no danger to anyone. if this trooper honestly thought this to be a sound idea, then he should be removed from duty. How does one go about accomplishing this?

Question - I was recently involved in a 3 person car crash while exiting the highway. I was the lead car getting on the exit ramp and when I slowed down on the ramp the car behind me apparently braked causing the car behind him to hit him forcing his car into mine. When the officer showed up he mentioned he was righting them warning tickets for following to close and thus causing damages to my car. Who is legally at fault here? Can they try to take me to court for something? If we do have to go to court, will the warning tickets they received show guilt/negligence on their part?

THESE LIGHTS ARE BLUE, SO WE INQUIRED WITH AS MANY LOCAL POLICE PRIOR TO HAVING THEM INSTALLED AND WERE TOLD THEY WERE LEGAL AS LONG AS THE CAR WAS NOT IN FORWARD MOTION AND IN A PARKING LOT. WE'VE HAD SO MANY OPINIONS BUT WANT TO KNOW THE ACTUAL LAW. OUR SON IS A SHY, RESPECTFUL, STRAIGHT A STUDENT AND A BANK TELLER AFTER SCHOOL. Thank you for taking the time to answer my question. I really appreciate it and respect the fact that you take time out of your schedule to go through these. I actually live in a town that borders Minnesota and my question is about a ticket I received in Minnesota.
I volunteer for emergency Search & Rescue in my home city/State (Borders Minnesota) and am a certified Emergency Search & Rescue driver for the American Red Cross. I get called in during natural disasters to get rescue and emergency personal to their destinations with my very well equipped vehicle. Because of my Volunteer search & rescue duties, I have a radio scanner installed in my vehicle. Going out in life threatening weather, and conditions, putting my own life at risk, It is imperative for me to have this to hear Emergency CB, Sky warn, Weather broadcasts, Ham channels, and of course the Red Cross frequencies etc...
My radio is completely legal in my home state where my vehicle is registered, where I live, where I have my license and where I perform just about all my search & Rescue Duties. I was over on the Minnesota side a while ago running an errand and got pulled over by a local Minnesota city police officer for a very minor infraction. I never received a ticket for this infraction but I did receive a ticket for 299C.37 Police communication equipment; use, sale.
I explained that my vehicle was used for search & rescue to no avail. After some research I found out that this law is placed under the section for criminal activity. Which is understandable as some criminals use scanners to listen to the police. The intent of the law was not to give tickets to law-abiding citizens who volunteer their time and services to the community. Especially giving tickets to emergency rescue workers from neighboring states.
What are your thoughts on this? What is common practice and the respected courtesy for rescue workers of neighboring states by Minnesota Law enforcement. Is it common practice for Minnesota law enforcement officers to ticket volunteer fireman, rescue workers, or county employees from neighboring states, who happen to have gear in their vehicles that are used in their home state and happen to wonder into Minnesota for something or another? Would you have given the same ticket?
Basically by getting a ticket of this type. I am being told to not help rescue stranded citizens of Minnesota during blizzards & life threatening conditions, etc.. Just stay in my home state.
I don't want to say what my vehicle is or try and sound like I have a big head as I don't. but the fact is, I am able to get to places and carry gear that no other vehicle in this area has. This past winter I even had to come to the rescue of several of several local PD cars, one of the a 4x4 that got stranded in blizzard conditions.
A side note. A little while after my ticket, I actually worked an event with my vehicle in my home state that was very big. The officer who wrote this ticket from Minnesota came over to my state and worked the same event with me. We saw each other and waved. Kind of Ironic...

Question - Why do you feel so strongly against tinted windows? Duh, they don't let you see as well at night and some people have ridiculously dark tint, but what is so harmful about 35% or even 30%? I was just looking around and what I found was the law says it must by 50% or higher in Minnesota. Is this the current limit?

Question - I sold my car to a Native American family in Mille Lacs as of August 2004. I signed the title over to them and they went on their way. as of yesterday, I got a notice from a towing company in St. Cloud stating that I am still the title holder and that they have my car in impound. Unless I pay such and such fees, I will be turned over to collections. I don't own the car anymore and did not keep anything as proof that I sold it. I did send in to the state the part of the title that reports the sale-- this document also contained all the buyers info. The state claims to never have gotten this form. That was the only place I recorded the information. What are my choices here?

Question - Ask a Trooper Question
What are the laws regarding colors of flashing lights on a vehicle. I know that amber is legal facing any direction as well as green. Rotating white is only for emergency personnel. However, I have heard mixed feelings on colors like red for example. Someone said red is OK facing the rear but not front. Someone said blue is completely out of the question etc. Could you possibly go over what colors are legal/illegal and what directions you can have those colors facing? I am a Metro Skywarn spotter who is looking to upgrade the warning lights on my car and am just wondering if I am strictly limited to amber.

Unless otherwise authorized by the commissioner of public safety, no vehicle shall be equipped, nor shall any person drive or move any vehicle or equipment upon any highway with any lamp or device displaying a red light or any colored light other than those required or permitted in this chapter.
I was reading through this and noticed the part "any colored light other than those required or permitted in this chapter." Does this mean that I could look up the permitted colors in St. Cloud (I assume that the permitted colors are those that are not used by law
enforcement/officials.) For example, I dont know of any officials using the color of violet/purple; white light may be another possibility. I know this may be a mis-interpretation of what the law is saying but a little clarification would help.

Question - I am a resident of AZ and have a car from AZ currently registered in MN. I have tinted windows legal in AZ but apparently not in MN. An officer checked my frosted salt coated window with a meter and ticketed me for illegal window tint. In AZ if you are in violation of tint it is a fix it ticket or fine if you do not fix it. As I stated I am a resident of AZ and need to know if the same applies in MN, And to the extent of liability for a non-resident.

Question - It's so nice to see that my tax dollars are going toward this Web site. It would be a nice resource if every other question wasn't a teenager looking to "pimp out" his "ride" with window tints or special lighting. Really, how many of these questions can you answer? Also, maybe they should try reading the past questions answered and maybe you should pay more attention to which questions you have answered. Some time ago, I submitted a question regarding child safety seats and laws pertaining to them, which was never answered. Can you honestly agree that 500 questions regarding window tints should out rank children's safety in your priorities? I see now why we have such a hard time keeping our kids safe on Minnesota roads. Our own troopers don't put that as their priority over window tints and trying to pull over the 'big money' tickets. Maybe if it was a stronger offense with a larger fine, troopers and police would start looking for these kids who are jumping around their parents cars on our highways.

Question - I purchased a 1-ton pickup truck. For the license plates, I was told that it would be a "Y" license. Several years ago, that designation meant that the vehicle could only be driven within a few mile radius (25 miles?) of the metropolitan city. A different license was required (more expensive) to drive "out state". Is this no longer true? Can I drive a Y licensed vehicle anywhere in the state?

Question - My daughter purchased her car in Arizona while working and living there. The windows are tinted more than allowed in MN. She is now living in MN and was ticketed for the degree of tint. At one time, she was told that all you had to do was prove where you purchased the car. Evidently, this is not true. Is the only option to have the tint removed?

Question - I am driving south on State Highway 65 in Isanti County doing 63 mph in a 65 mph speed zone. A marked Isanti County Sheriffs vehicle passes by me obviously speeding. About 3 miles down the road he is sitting on the shoulder and as I pass he pulls behind me and makes a traffic stop. He offers an explanation that he had ran the license plate number and saw that the owner of the vehicle was revoked to drive in the state of Minnesota. I asked if I had done anything improper and if my driving was all right to which he replied no I had not and my driving was fine. So in short my question is, did the officer have the right to run a vehicle check since I was not committing a crime nor was I suspected of committing any crime? Would this be considered a spot check?

Question - Can a state trooper stop a motorist just for not wearing a seatbelt? This would be the only reason the motorist would be stopped. I know you can receive a fine if not wearing a seat belt if you are stopped for another offense. I have been told by one trooper you cannot and than another, one says yes. Whom do I believe? Question - I have seen way too many extremely rude people driving 75-90+ mph not signaling, quickly changing lanes, tailgating, ON THOSE CELL PHONES cutting others off on the way home from work every day at 2:30-3:00 pm on 694 westbound between Silver Lake Road all the way up to 494/94 north to Elk River. It's really getting dangerous out there! Can they put a new law in effect keeping people off those?
Out east (Maryland?) they are using fiberglass 1/2 trooper decoy cars with backup real troopers with radar further down the road. Has Minnesota thought of this? This would cut costs also, and more important save lives! On 35N to Duluth, this would be great hiding in between those highways.

Question - I was recently stopped for speeding by a city police officer in town. It was a speed trap, 4 officers. One operating the radar, the other 3 to stop cars. When pulled over I was told I was going 50 in a 35. I highly doubted this because my speedometer showed 37 MPH at the time I came to the officers and I was in 4th gear in my truck. (I tried later to get up to 50 in a zone where 50 was allowed in 4th gear, 36 is as fast as it would go before hitting the engine speed limit). The officer was in a hurry to issue the ticket. I had just bought the truck out of state and titled/registered the truck the day before. The plates where also new. She wrote the ticket in record time, less than 4 minutes. I didn't look at it to close but under year/make/model she put "white semi-truck." There are several problems with this. First off, it is NOT a semi-truck, I don't even have a class A, there is no year listed, no make, no model, no nothing. I was never asked to prove that I just bought the plates (the yellow receipt from what I am getting at here is this. I would think the ticket has to be filled out correctly, and it seemed in the officers hurry she skipped over VERY important information (it was a commercial straight truck). I was never asked for insurance, logs, inspection reports, registration, authority or anything I am normally asked for during any traffic stop or visit at a weight station. If the officer was this clumsy in her job of writing the ticket, who is to say they clocked the right target?

Question - HI! This is Corey the host of THE streets are talking on 900 am wurd. Its a talk show and we have had some callers complain about their tinted windows being the cause of them being stop in some counties of Pennsylvania. In Philadelphia the city they don't get stopped, but in other counties of Pennsylvania they are stopped and told its illegal to have tinted windows. So the BIG question is, if you live in Philadelphia and its legal but you drive in other counties or even in other states where its illegal to have tint, what do you do? Would love an answer. Don't mistake me or this question for someone who just wants out of the laws passed because I realize they are made for peoples protection and are in place to make this world a better place but wouldnt it be a little better place to live if the officer instead would give you a warning when you said you had purchased the vehicle used and had no idea the tint was illegal? I
would understand if I was pulled over for it several times before and told it needed to be removed but the simple case is I have been pulled over several times for small traffic violations and never once has a state, county, or local officer ever mentioned anything about it. This is why people get so fed up with law enforcement officers because some know that when I go to contest this ticket and make my plea. I guess what my question should be is why did you just waste your time to read this when you could be doing something to make a difference and did you read this while on my tax dollar.

I have a few questions about vehicle modification in this state. I understand perfectly well that undercarriage neon lights are illegal to use on the street (though, how is it that an officer can cite a driver who's neons are off and are never on when the car is on public roads?), but I was rather curious about in-cabin lighting. I recall reading somewhere that lighting in the interior of a vehicle is all right as long as it is below the shoulders (if it is in front of the captain's chairs) and it is all right anywhere else behind the driver so long as it does not block side or rear windows and is not distracting to other drivers. Are these correct assumptions, or am I receiving dubious information?
Also, I was curious about other lighting modifications to vehicles. As I said, I know that undercarriage neons (and neons anywhere else on the exterior of a vehicle) are illegal, but what about a modification known as "Angel Eyes"? I believe they come standard on some BMW's and other "premium" vehicles. They are small fiber optic rings around the headlight reflectors that glow white, blue, red, etc. They are often all but drowned out in the light of normal headlight use, so I wouldn't see why they would be illegal. If they are, I would like the MN statute that states this, if possible.
And finally (yes, these are all about lighting ;) ), many vehicles now have turn signal lights on their side mirrors as an extra precaution to allow others to see the driver's intent. I was curious if adding a row or two of dimmed LED lights to the side air vents on my vehicle would be in violation of any statutes. They would only be active when my turn signals are in use and would be timed to coordinate with said turn signals.

Question - I get off work at midnight and am stuck driving m-f during peak drunk driving time (mid-1a). I moved to Isanti in jan 2001 and have been pulled over in Anoka County, but not ticketed, 12 times since I've moved there. I drive a small sports car. I understand they were checking for alcohol, but it is getting really annoying.
I drive to Minneapolis and back, a total of 90 miles 5 to 6 times a week. I've been pulled over ONLY Anoka County and never ticketed, because there was no cause. I don't speed Period. I don't want a ticket and learned the best way not to get a ticket, is to not speed. However...the following happened and I feel so violated and unsafe on the road.
Last week as I was making my way home, a car was approaching with it brights on. They were left on as it kept approaching. I waited and eventually did a quick flash. The car passed me and my heart went in my stomach. I thought it was either a drunk angry driver or an officer. I checked my speedometer and I was going 55, so didn't need to alter it. It swoops up behind me and then on goes the lights. I pull right over.
The officer tells me I was going 65. I absolutely was NOT! I asked if I was pulled over because I flashed my brights and he said he didn't remember that. What? I was lied to...bold face...lied to...! I wasn't speeding and he did have his brights on. Now I'm afraid of how to protect myself in the future. It's his word against mine.
I've been told that the Saint Francis Police Department is always full of new young cops and are notorious for ticketing. How can this happen? How can I protect myself? It affects my insurance and my financial situation. I feel SO violated!

Question - Recently I was stopped by Airport Police by a 3-month tenured officer. The officer approached my vehicle and asked for my license and insurance. I handed him my license but couldn't locate my insurance. He asked me to stay in my vehicle, returned to his (about 20 yards back) and while he was in his car, I located my insurance card. I "foolishly" got out of my car and held up my hands with the insurance card in my hand and walked on the side of the road toward his vehicle and announced I have my card. He got out of his car, charged me while pulling his gun. He pointed his gun directly at me and screamed, "I said, do not leave your vehicle, get back in your vehicle." Question - I am a former Minnesota resident, turned Wisconsin resident and am currently back here in Minnesota attending school at the U of MN. Recently I was given a ticket while parked in front of my house for not displaying my front license plate. I was very disappointed about this as I was told that truck owners in Wisconsin do not need to display their front license plate. All the evidence up to this point supported this theory as: I have parked in the same spot for two years and have not received such a ticket. I've been pulled over by a state trooper who passed me in broad daylight from the front and did not mention a thing about it (someone claimed to have seen a swerving red pickup in the area - once the trooper saw that i was not drunk he let me go and apologized). When I receive my tabs, I am only given one set, not two like in Minnesota. Finally, in the past three years i have received three parking tickets in Saint Paul and Minneapolis (meter/contract lot violations) and none of these officers pointed out the fact that i had a missing front license plate and/or the more important fact that it was illegal not to have one displayed.
Getting back to my story...
I was disappointed by my lack of knowledge and wanted to do anything in my power to fix the situation, however, the truck that i own used to have some kind of manufactured plastic attachment that would allow the license to overcome the tilt of the bumper. And the main reason of why i don't have my license displayed in the first place is due to the fact that the previous owner of my truck was backed (or so he said) and lost the plastic attachment and front plate in the process. When I bought the car he said it wasn't necessary and the only reason he had one on is because of the plastic attachment thing looked bare without it. Therefore, the spot of where my license should go is at severe angle and has two bolt/rivet looking things that block any sort of way to easily attach my new plate. Granted there is a 2" strip of plastic higher up that i might have been able to fasten the plate, but it seems way out place and even if i wanted to fasten it there, you have to remember, I am a college student who does not own a screw-gun or drill and in this cold a screw and screwdriver would not penetrate the bumper. So with no other option, i took out the license and set it on my windshield (IÅve seen other cars do this before), until i could make it out to a dealer to have a new plate put on. Well, in the
Mean time i had classes and work to attend to, so i figured my temporary solution would be okay until the weekend. Unfortunately, i was wrong; I got the first ticket on a Wednesday and got the exact same two days later, by the exact same officer.
Therefore my questions to you are:
Don't you think this is a bit harsh?
Is there some kind of grace period for this kind of thing?
Did the officer expect me to try to find an ally and park it off a public street?
We both know this is also illegal and i rent a place with no off-street parking. What else could I have done? (Keep in mind on Thursdays, i work from 8-1 in St. Paul computer lab, have class from 2:30 - 5:15 and have to be back in St. Paul for a short from 6 û 9. Point being that all the dealers are closed by then.) Couldn't the officer just give me a warning?
I know that in state residents can dispute tickets with a hearings officer. Will I still be able to do this?
I heard that tickets by out of state residents can only be cleared up in the court system. This cannot be true for things as trivial as parking tickets...right.
My opinion, although biased, is that this officer was a bit harsh. I am 23 and have a spotless record. Besides the aforementioned parking tickets, i have never received any other kind of tickets. I pay for my own college education, pay insane amounts of money for car insurance even though i have never been in any sort of accident and try to uphold
the law whenever possible. Yet, I feel a bit depressed almost like i have been taken advantage of. Don't you think it is a bit crazy that i have to pay more money in fines ($170) than people do for things that actually endanger citizens...like speeding or not pulling over for emergency vehicles, etc...?

Question - Hi, I was stopped the other day down by centennial high school going 52 in a 35. It was my first offense and I donÅt know if I have to go to court or just pay the fine or call somebody or who to call. Question - Hello, my wife has not been driving in Minnesota very long and asked me a question I cannot properly answer.
The question is this:
If driving on a freeway, with the posted limit at say 60 mph, is it legal to pass someone in the left lane while doing 60 (assuming there are not others driving faster then the posted, which is frequently the case). I told her yes. She followed up with asking if she could be stopped for doing the speed limit in the left lane, while others are wanting to drive faster. I told her to simply move over when it was safer, and not to worry about others. Any other advice for her?

Question - My 15 y/o just informed me -he learned in drivers' ed. - in Minnesota, the seat belt laws are only for the driver and any passengers under 12 years of age. He further stated that if he were driving (until he is 18) everyone must be belted. Is this true? Question - I have heard that Minnesota Window tint laws are unconstitutional as a violation of the Equal Protection provision of the Minnesota Constitution.
"The District court held a contested omnibus hearing, after which Minn. Stat. 169.71 subd. 4 (3) was found unconstitutional as violating the equal protection provision of the Minnesota Constitution by permitting people driving vans or pick-up trucks -- but not cars -- to drive with excessively tinted rear and side windows."
As for safety, I would venture to say dark window film has many positive aspects. It reduces theft and improves vision at night by blocking ambient light and the blinding headlights of vehicles behind you.
Don't you also have a constitutional right to peruse privacy even in a public place?
Tint also protects the interior of your car.
The only argument for, seems to be "officer safety issue"... If that is the case, and it is so dangerous to approach a vehicle with dark window film, then why is it the law is written to put officers in the situation that every time a vehicle with "dangerous window film" is spotted that that officer is supposed to approach the vehicle and inspect it. How come vans, trucks, and limo's can all have the tint? Is a van with tinted windows safer to approach then a car with tinted windows? That just doesn't make sense!
Can't someone in a house be an "officer safety issue"? Maybe people should live in a clear plastic bubble with big brother watching. Then we wouldn't have to worry about terrorism.
When someone has window tint. Who is the victim? "Land of the free, home of the brave" I thought police / troopers were supposed to protect us, not oppress...
At least it's not the whole country that's messed up and just Minnesota and a handful of other states.

Question - After repeatedly asking that my four-year-old stepdaughter's mother use her booster seat when transporting her in the car, she showed up without one again. I have talked to her about it so many times over he past three years that we have had custody of her. One time I had to cancel the visit because she tried to leave with her sitting on her lap while she was driving! I try informing them (her parents as well) of the dangers of not having her properly restrained. They also let her seven year old brother ride in the front seat (yes, they have air bags). I have been doing some searching regarding the laws, I know the regulations, and I want to know the consequences. From what I have found, it is a petty misdemeanor and a fine of $50 that can be WAIVED. How can this possibly be true? Can it truly be regarded as a higher offense to not carry insurance on your vehicle than to endanger the life and well-being of a child? In addition, as a person of law, what suggestions would you have to make it stick in their heads?

Question - When did these laws of "50%" window tint on passenger vehicles get passed? Reasons? Behind the driver, in the past, was possible to be blacked out completely. I drive a "Police Interceptor Crown Victoria" formerly a South Dakota squad car. For arguments sake, let's say the windows behind the driver were tinted due to being a "K-9 unit," and I wish to leave the tint on the windows, what can I acquire in the form of a document or letter that will allow me to retain the tint, which is ONLY on the side windows behind the driver, as the rear window is still clear. If needs be, I am prepared to get a doctors note and then will tint all windows but the windshield, but I would rather not be forced to be dishonest, simply because Minnesota. has laws that are unreasonable.

I have a car parked in front of my home since March of 2004. I received a citation in the mail stating I owe $50.00 for a parking fine. There is no ticket on my car and could not be found anywhere. I called my local law enforcement center and they stated that they have the right to ticket a car if it hasn't moved for 48 hours.
I have never heard of this law and I am surprised the officer didn't knock on my door to tell me to move the vehicle to avoid a ticket. I am on disability and am pretty annoyed. The house I am living is a rental and the landlords have it up for sale. I did not want to move the car in the back yard because I figured it would look tacky to have the car parked on the lawn when potential buyers are coming to inspect the home. Then the officer told me I cannot have the car parked on the grass in the back yard either as I can get fined for that also! Do you have any laws and answers for me in regard to this matter? Question - I know you didn't see what happened, but I just would like to know if what I did would be considered Inattentive driving to you. I was driving down a busy freeway in the far right lane when I say lights of a police car ahead off to the shoulder, so I started to slow down as I passed the squad car I say that there was a accident about 1/4 mile ahead off to the right shoulder as well. So right then, the car that was in front of me that I had 3 car lengths between us slammed on her brakes almost to a stop, so I slammed on my brakes as well and the only thing I could do to avoid hitting her was to swerve on to the shoulder, so I did and got right back behind the car as it started going again, still about 1/3 of a mile before the accident. And continued down the freeway for about 4 miles until I was stopped by a peace officer.

Question - While visiting a large town in MN we were traveling east bound on a two lane, one-way street. We found the house where we were going to be visiting, but the person was not home, so we were pulling out of the right hand lane, which we were parked on, mind you the house was on the corner of the block on the right hand side, there was no way to get into the left lane, to make our turn onto the two lane street, As we were pulling out to make the L hand turn, there was a car to our right, which we did not think was going to stop for the stop sign, the driver of my car waited until he knew for sure she was stopped, and then looked in the mirror, and proceeded to make our L hand turn, our car
Just started to turn, to the north and we were hit by another vehicle eastbound, which was behind us (He was SO close behind us that my driver could not see him in the mirror, the vehicle was in a "blind spotÉ in the mirror.) The driver of my vehicle was ticketed with an "Inattentive driving" ticket. The person, who hit us, spun us straight forward and proceeded to run straight into a tree. He was not wearing a seat beat and was talking on the phone. He did NOT get any traffic violation. All persons in my vehicle were wearing seat belts. I just feel that with my driver getting this "extreme" ticket and the other driver getting nothing is wrong. What do you think?

I went there and they cannot find the ticket, it may have been issued by a Trooper, I can't remember since the patrol car was unmarked.
At the courthouse all they could give me was a print out of the violation.
The Agency# is MNHP0400 (Golden Valley district). The citation number is HPRA-007679.
Is that number a MNHP ticket number? and where would I go to get a "order to remove" if it was a Trooper that issued the ticket.

Question - Is it legal to leave my car running without my keys in it and the doors locked if I use a remote starter. The remote starter has all the safety devices to shut the car off if someone tries to get in or even attempt to steal it, it will shut down the car and electrical system until a key is used.

Question - If you receive a written warning for a moving violation (in this case, speeding), does this appear on your driving record?
I have heard that insurance companies don't know, but obviously the police have some way of knowing if you have prior warnings. So how exactly is this recorded, who sees it, and how does if affect me (ie insurance, license renewal, etc.)? Also, how long does such a warning stay in whatever record it's in?
Finally, if I got a speed warning, does this affect the vehicle's record at all? If I share a vehicle with my dad and we have each received, a warning for the same thing within 7 months (in different states) will that have an effect on the way an officer views the situation if I'm pulled over again? Will he/she see both warnings on the vehicle and decide to issue a citation?

Question - I received two tickets for side windows with too much tint. One in was in Anoka and Anoka County. This went on my driving record as a moving violation.
The second was in Minneapolis. I had the tint removed (after the second ticket) and replaced on the driver and passenger front windows. (Four door car) When I was in getting a continuance in Minneapolis the administrator noted that the Anoka ticket was incorrectly on my record as a moving violation. The same statute on both tickets. It is showing up on my record and my insurance was raised due to that ticket.
Is this normal and legal that Anoka can make that ticket a moving violation? No one seems to be able to answer and how I can get this changed if possible.

Question - I have a bet going with my parents about the seat belt law.
I am 15 years old and when my dad or mom are driving, I do not have to be buckled up if I am in the back seat. I know the drivers Ed book says that kids over 11 donÅt have to wear their seat belts if they are in the back seat. It also states everyone has to wear their seat belt the driver has a provisional license or permit.
My parents have a regular license not a permit or provisional license so there fore I am correct but they wonÅt believe me so they told me to ask a cop or a state trooper.

Question - This past summer I was walking down a city street in Stacy. I had a case of beer in one hand and an open one in the other. Is was stopped by a trooper just to check my ID. In the mean time I poured my beer out when I seen him coming figuring it wasn't legal. Question - My question pertains to a citation that I received recently. I was pulled over for illegal tint on my windows and for having a suspended object (air freshener) hanging from my rear view mirror. I recently moved to Minneapolis from South Dakota, but had not yet applied for a Minnesota driverÅs license, though I have lived here for more than 60 days. Since I just moved here, I was unfamiliar with the laws pertaining to these violations. The tint level is legal in South Dakota and I didn't realize it was different from state to state. I understand that even though I was unaware, that doesn't make it any less illegal. If I have the tint removed and apply for a Minnesota drivers license, is there much case for me to more or less plead ignorance and hopefully have the fines of $430 waived? I am a student at the U of M and have been told by a few people that the law of switching over your license doesn't pertain to students, but I would assume that would be if that student still claims legal residence in another state.

Question - I had a suspended driverÅs license due to a non-paid tabs ticket. Now I paid this ticket on a Friday and the person at the place told me to wait until Wednesday for my license status to change. I waited until then and started driving again on Thursday. on Friday, I was pulled over for no apparent reason. When the officer came up to my car he said he ran my plates and found I have a suspended license. DoesnÅt an officer need to have a reason to be running your plates? Because I had nothing wrong with my car and everything was current. However, my question is if you had to slow down for a semi half in the straight lane and half in the turn with its blinker on and you are in the turn lane behind him with your blinker on and talking on a cell phone. Question - On 24 November 2004, I was flagged down by a man while traveling through Foreston on my way to Mille Lacs Lake at 1935 hrs. The man said he needed help, and pointed at a car that had slid off the road and rolled into a swamp. Being a full-time professional Firefighter/ EMT I thought it to be my moral, ethical, and legal responsibility to assist. While the man call 911, I struggled doing patient assessment on the individuals due to language barriers. As I was doing my last assessment, the troopers showed up and said these exact words. Who was driving, who was the first witness, EVERYONE ELSE (pointing at me) GET THE HELL OUT OF HERE! (Exact words yelling) Not, is everyone all right. Not, is any one hurt. These people could have been dying, he didn't care. I am legally obligated to help the injured until relieved by the next higher level of care.

Question - I am wondering what the legal sound decibel is for say dual exhaust, or any exhaust for that matter. I have a hot rod and when I had the exhaust work done at a local shop that specializes in hot rods they insured me that the car would not be to loud. Question - I have a question about signal lights. I had an accident on Highway 61 and 4th Street. The signal lights were completely out as if there was a power failure. We were all stopping as if it had become a 4 way stop. When it was my turn to go, the other person did not stop and hit the side of my vehicle. She claimed that her light was green. I presented a claim to her insurance company, and even got a letter from the MN DOT which stated that the lights were not working at the time the accident occurred. The other insurance company still denied my claim.
I know I have been taught that when a signal light is completely out like that, it should be treated as a 4-way stop. Everyone I have talked to says the same thing. I have looked for support of this, and have been unable to find anything. MN Statutes do not state what the
duty of a driver is when the stop lights are in dark mode (such as during a power failure) where it is not blinking red.
What is the correct thing to do when a signal light is inoperative like that? If it is to treat the intersection like a 4-way stop, what law or statute or rule supports this? Is it just a common law duty or is there case law? I would really appreciate your answer to this.

The situation: My husband and son-in-law went to Wisconsin Labor Day weekend to bring home a tractor he had bought there. Before leaving, he filled both fuel tanks on his truck with fuel at the local gas station. On the way home, in the dark amid severe rainstorms and tornado warnings, the truck stopped running. It turned out that the first tank had run out of fuel, and, though he tried all he could think of, he could not get the switch to change over to the second tank. Leaving the truck parked on the shoulder and wallking through a storm in an unfamiliar area would have been hazardous to both of the men, as well as to other motorists who might have difficulty seeing the parked truck and trailer (or the pedestrians) in such poor conditions. He decided to fill the empty tank with dyed off-road fuel from the tank, which we have mounted in the truck for transport of fuel to our farm tractors in the field. The next time he used the truck, he was stopped for a random inspection and was fined $1,000 for having off-road fuel in one of the tanks. Is there any basis in the law for fighting this fine? That is, are exceptions allowed for emergency situations where common sense says safety considerations should dictate one's actions?

Question - I am wondering if it is legal to have a specialty printed license plate mounted below the rear or front state issued license plate via screws, etc. I know it is not legal to put one in place of the actual state plate. I have seen this done a lot before. The reason I am asking is we own a business and can specialty print on license plate blanks & license plate frames. I know each state has different laws regarding specialty plates not state issued. Question - Hello,
I was wondering if it is unlawful to get into a turning lane prematurely? I was driving and traffic slowed and instead of slamming my brakes on I put my turn signal on and proceded with my right turn. Then just as I did this an officer stepped out into the turning lane and flagged me over and gave me a ticket. He said that only busses could be on the shoulder and that I was driving on the shoulder. This frustrates me because I never knew there was a law that states avoid slamming on your brakes and do not turn into the right turning lane prematurely. I turned into the lane about 60 feet before I thought what was the turning sign on the right but was an only busses sign driving on shoulder. I have been very cautious now watching busses on how they drive, cutting in on traffic when and where ever they want and congesting traffic more. If I am wrong with this premature turning then I will admit it but if I am wrong then we should have lanes just for busses where they can.

Question - I was in college in SC and had MI plates and registration because I am a student and that is legal. In SC window tint is legal and my windows have been tinted for 3 years. Then I moved to Michigan temporarily for about 3 months and then decided I did not want to stay here and I am moving back to SC. Question - I was recently in a parking lot accident involving one other car. I was backing out of a parking space when he was coming from the road into the parking lot. He hit me in the back left tail light with the front left wheel well, right above the wheel. There were parking spaces on both sides of the parking lot and where I backed out to there was enough room to fit three cars. The thing is, that in order for me to get out of the spot I had to not only go straight back, but I had to turn the wheel to the right then, straighten out again in order to avoid the other parked cars. The distance between the entrance of the lot and where i was backing out was only about 50 to 75 feet, so there wasn't all that much time for myself or the other driver to react. Nevertheless, the way I saw it, he seemed to be in the middle of the road in the parking lot, that's why he hit me. I have no idea who is at fault due to me taking a different angle to back out and the other driver being towards the middle of both lanes. Who is at fault?

Question - In November of 2003, a juvenile court traffic judge ordered the whiskey series plates for my vehicle because a child that I am guardian of (he is now 18) drove my car without a license and had an accident. Question - I was given a ticket for parking in a fire lane, and later that night a police car was parked in the same exact spot where I received the ticket and the officer was in the store buying a bag of chips a soda and a sandwich. When I asked him, how come he could park there his only response was to point to his patch on his sleeve that said Police. Now at this store not more than 50 feet from where he was parked was a parking spot marked emergency vehicles only. Question - I was recently pulled over for smoke coming out of my exhaust pipe. I am 16 I got off work around 11:45 that night and I had a 19-year-old friend with me. I went and cashed my check (first spotted by police officer). I got pulled over and my car was towed for not being registered but it was registered and the paperwork was not filed on time by DMV. When the tow truck came the police officer gave me the tickets and then left me on the side of the road knowing that I lived 40 minutes from where I was pulled over and I told him that I could get a ride but it was going to take a while for the ride to get there. My 17-year old son received a ticket in Anoka County when he drove his car on the grass by the Rum River to fish. The ticket is a "Recreational Vehicle Trespass" ticket. This was not in a park but just behind some commercial buildings where there were other cars. Now I have to go to Juvenile court with him and I have no idea what the fine would/could be and am unable to get any information from the court administrator. Is there a standard fine? Does it make a difference that it was a car and not a "recreational vehicle"? Should we bring pictures to court of the area?

I just had a question. I recently was pulled over for driving on a suspended license with knowledge. However, when the officer asked me if I knew what he stopped me for I said no. then he continued to say that I had not paid a ticket from over 2 years ago for speeding. Moreover, I stated to the officer that I had paid the ticket over to years ago but it was paid late and therefore my license had been already suspended for non payment. After paying the ticket, the local Clerk of Courts told me to go show the DMV office the receipt and pay $25 to have the license reinstated. I proceeded to do just that. Paid my fine, paid the fee to the DMV office and she handed me back the paper with the stamp on it. I believed that this matter was over. But it apparently did not get completed and now I have to travel away from home (approx 2 hrs) to court for someone else’s mistake. However, the officer who gave me the citation said he believed my story.

When a police car is on the side of the road at night with only normal vehicle lights on, (headlights, taillights) and no one pulled over, how is it possible to receive a ticket for not yielding to an emergency vehicle? My question is…I live across the street from a repair hobby shop. He has worked on over 20 separate cars. The operators of this shop work on their cars in the garage with their doors open, until 1:00 a.m. on many occasions sometime as late as 4:00 a.m. The operators of the repair shop work on street rods. For example, a stock Chevy has been modified to race. I would guess the db noise output at 75 to 100 db.Up to five repair operators/hobbyists cars are parked outside my families bedroom window at 20 feet distance. These cars are also modified street rods in the 75 to 100 db range. When they leave the repair shop at 11:45-1:30 a.m. They are very disruptive to our sleep. I was told this bus DOES NOT require seat belts according to our state law after the trooper asked his direct supervisor to confirm his answer. I did not get my answer in writing due to the trooper and I speaking over the phone that day. However, it is imperative I now have something in writing as I transport children as a Minnesota licensed childcare provider in the county of Dakota. I live on a secondary gravel road in rural Montgomery County. Four years ago, the county highway department took down the 30 MPH speed limit signs. Recently, due to speeding drivers, I requested signs be put back up. The highway department put up 55 MPH signs (on a gravel road). There was never an ordinance change. Was this legal? When I was younger... I had a friend that received a ticket for rolling a stop sign. He told me that the officer giving him the ticket said "The definition of a *complete stop* is when the wheels of the vehicle stop moving for a period of 2 seconds or more." He said the officer told him "If you do not follow that rule it is considered rolling a stop sign."
That was years ago and I have always followed that rule. Now I am teaching my daughter to drive and using that same rule. The problem I am having is her friends and boyfriend is telling her that I am wrong. That it does not have to be two seconds... and that by following the 2-second rule she is stopping for too long at stop signs. (Personally... I think it does take at least two seconds to make sure it is safe to go... so that rule sounds right and fair to me)

I am looking for portable meters to allow our law enforcement officials to measure tint reflectance. While I have found tint transmittance meters, I have been unable to locate any reflectance meters.
Your regulations stipulate “a luminous reflectance of more than 20 percent plus or minus three percent."
Is this measured using meters, or is this information reported on the accompanying sticker.

Are TireFlys* illegal in all states or just a few? If there are then which states? I have a pretty clean record and I'd like to keep it that way. Thanks

I would like to know if it is legal to tint the windows on a semi truck, and if so do I have to have a doctor's prescription? In addition, if the tinting is legal in my state, Missouri, will it be legal in all states?

If some one outside of the family is driving your car and is stopped for drunk driving can the officer take the plates of the car? This is what I was told happened. Now she has plates that start with WU. Are these whiskey plates?

I was curious as to how a law enforcement official can legally pull someone over simply because the description of the legal driver of the vehicle does not match the description of the ACTUAL driver? There was no other stated reason for pulling this guy over, other than the fact that when the trooper ran the license plates, he could visibly see that it was not a female driving the vehicle. What concerns me here is threefold:
1)There was no just cause to pull over said person.
2)The car was not reported stolen.
3)There is no law (to my knowledge anyway) that disallows someone else to drive your legally registered vehicle providing that a).that person is a legal driver and b).the vehicle is insured. In this instance, this was the case. Your thoughts please!
