Elk River man facing 14 felony tax charges

Saint Paul, MN – The Minnesota Department of Revenue announced today (Tuesday, Dec. 22) that Daniel Darlington, 48, of Elk River, was recently charged by the Sherburne County Attorney’s Office with fourteen felony tax crimes.

Darlington is facing four felony counts for evading income taxes, three felony counts for evading corporate taxes, two counts for evading sales taxes, two felony counts for making sales after permit revocation and three felony counts for evading withholding taxes for tax years 2005 through 2007.

According to the complaint, Darlington has owned D.D. Corporation, also known as Sandie Beach Tanning Salon in Princeton, since 2002. He was contacted by the Minnesota Department of Revenue numerous times to file his tax returns and set up a payment plan. When Darlington allegedly failed to make payments, his sales tax permit was revoked, and he was told he could no longer make taxable sales.

Department of Revenue investigators visited the business and found out it was still operating after the sales tax permit was revoked. Later, Darlington admitted he kept the salon running after the permit was revoked, which is a felony.

The complaint also states Darlington’s income as $39,000 in 2005, $49,000 in 2006 and $87,000 in 2007.

Each felony is punishable up to five year in prison, up to a $10,000 fine, or both.

The Minnesota Department of Revenue is dedicated to enforcing tax laws, collecting no more and no less than taxpayers owe.  It takes progressively stricter measures against taxpayers who demonstrate that they will not voluntarily meet their obligations.
